The context will determine whether Easy Drive refers to one or multiple entities. Each Company entity may perform different roles regarding your loan, such as acting as a broker or lender. This consent covers the roles of each entity. References to the singular (‘I’ or ‘me’) include the plural (‘We’ or ‘us’).

This privacy policy outlines our compliance with the Privacy Act 1988 (Privacy Act). Terms ‘personal information’ and ‘information’ are used interchangeably, following the definition in section 6 of the Privacy Act.

Easy Drive collects personal information to provide requested products and services and information about other products and services offered by or through us. We protect your personal information in accordance with the Australian Privacy Principles (APP) under the Privacy Act, available at: https://www.oaic.gov.au/privacy and any applicable industry privacy code.

Why We Collect Information

Easy Drive collects information for purposes reasonably necessary for or directly related to our business functions or activities. These include:

  • Providing products and services requested by customers, and monitoring, evaluating, and delivering products and services.
  • Assisting with queries, resolving complaints, managing information access requests, or handling legal actions involving easy drive.
  • Managing customer relationships, accounts, and performing administrative tasks (e.g., risk management, system development, credit scoring, staff training, debt collection, and market research).
  • Offering information about products and services from easy drive affiliated providers, and external providers we represent (unless the customer opts out).
  • Complying with legal obligations, such as the National Consumer Credit Protection Act 2009, the Privacy Act, and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.
  • Identifying customers or establishing tax status under Australian or foreign legislation, regulation, or treaties, or agreements with tax authorities.
  • Gathering and aggregating information for statistical, prudential, actuarial, and research purposes.
  • Developing and implementing measures to detect or prevent fraud and credit loss.
  • Assisting with marketing and promotional purposes, including disclosing personal information to third parties, contractors, or organizations aiding our marketing and promotion efforts.

Additionally, under Part IIIA of the Privacy Act, we may obtain your consent to collect, use, and disclose information about you. If you do not provide the required information, we may be unable to offer you the requested goods and services.

What We Collect

Easy Drive collects personal information such as name, address, date of birth, gender, marital status, occupation, account details, contact details (telephone, facsimile, email), and financial information. We may also collect personal details for identification purposes over the telephone.

For credit applications, we may collect information about your dependents, current address duration, employer’s details, length of employment, proof of earnings, and previous employment details if applicable.

Disclosure

Easy Drive will not disclose your information to government agencies, private sector organizations, or anyone else unless:

  • You would reasonably expect or have been informed that such information is usually disclosed.

Identity Verification and Credit Checks

Easy Drive is legally required to conduct identity verification and credit checks under legislation like the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 and the National Consumer Credit Protection Act 2009. Information from online or in-store applications may be used to verify details and conduct credit checks, including e-verification.

Consent for these checks will be sought during the application process. If there is a partial or no match, further documentation may be required for verification.

We may also access and collect your financial records from your financial institutions via an online portal with your consent. This service removes the need for physical financial statements.

If you fail to meet a payment obligation or commit a serious credit infringement, we may disclose this to a credit reporting body. You may request a credit reporting agency not to use your information for pre-screening direct marketing or if you believe you are a victim of fraud.

You have the right to request a copy of your credit reporting information once a year or if it relates to our refusal of credit.

Your email address is used only to send you information that you have requested and as necessary to complete a transaction or application or for marketing purposes. As part of your use of our email marketing software, Easy Drive allows you to elect to receive, or not to receive, certain information.

Easy Drive will not send you unsolicited email information related to marketing and promotional purposes where you have opted out of receiving such communication, offers or advertisements. Company will not sell, rent or lend our contact lists or our customers’ contact lists (including customer data) to third parties.

Our Complaints Handling Policy

Introduction

We Easy Drive Pty Ltd T/As Name, Australian Credit Representative number xxxxxx) are committed to providing all our  customers with excellent service. However, if you  or any customer believes we have not adequately  met our obligations, or you have a complaint about  any of our services; we encourage you to let us  know so we can resolve to your satisfaction.

What is a complaint?

A complaint is defined in AS/NZS 10002:2014 and  ratified by ASIC as “an expression of dissatisfaction  made to or about an organisation, related to its  products, services, staff, or the handling of a  compliant, where a response or resolution is  explicitly or implicitly expected or legally required.”

Any person who is dissatisfied with our service, for  any reason, may contact us to complain.  Sometimes we may receive negative feedback,  which is not an actual complaint and as such may  not require a resolution or formal follow up. Whilst  we welcome feedback from all our customers, this  policy does not apply to feedback of this nature.

How to lodge a complaint

If you have a complaint to make and you have not  been able to resolve it to your satisfaction with the  staff member involved, we encourage you to let our  Complaints Officer know via any of the following  contact points:

  • Copies of any documentation or correspondence supporting the complaint

Extra assistance

Should any extra assistance be required to resolve  this issue, including language interpretation please  let our Complaints Officer know. We will then  attempt to rectify any such challenge.

Our internal resolution processes

Upon receiving a complaint in writing, our  Complaints Officer will attempt to contact the  complainant within a maximum 24 hours, using the  same medium that complaint was received or in a  manner requested by complainant. This initial  contact will be to at least acknowledge receipt of  the complaint and our intent to investigate and  resolve asap.

Subsequently, our Complaints Officer will  proactively and respectfully address the matter  directly with the complainant with an intent to  resolve within 5 business days. Sometimes this will  not be possible, but in all circumstances, we will  formally respond in writing within a regulatory  maximum of 30 calendar days from when the  complaint was first received.

Within this 30 day period, and unless resolved to the complainant’s satisfaction within 5 business  days, our Complaints Officer will put in writing the  following details to the complainant:

  • Details of complaint received.
  • Contact details of our Complaints Officer.
  • Outcome of our internal complaint investigation, including steps and decisions taken.
  • An explanation of our decision measured against complaint made and investigation taken.
  • The complainant’s right to contact our External Dispute Resolution body (see details below should they not be fully satisfied with the outcome of our internal process.

Credit Guide Overview

The National Consumer Credit Protection Act 2009 states we must provide consumers with a Credit Guide and Quote as soon as practical after it becomes apparent we are likely to provide credit assistance. The Credit Guide and Quote contains information on the service we provide, details of our obligations under the NCCP Act 2009 to ensure credit is not unsuitable for your circumstances, maximum fees and charges payable to us by you as the consumer, a guide to the commissions we may receive from credit providers, and details of fees that may be payable by easy Drive to third party referrers.

Services we Provide

Our Credit Assistance services in sourcing and arranging a suitable loan include:

  • Obtaining further information from, including but not limited to, employers, accountants, and credit reporting agencies;
  • Investigating suitable loans and providing you with information about one or more loans that meet you objectives;
  • Assessing, verifying and documenting information, ensuring the chosen loan is not unsuitable for you;
  • Helping you complete the application, compiling the document required by the credit provider and submitting the application to the credit provider;
  • Liaising with the credit provider during the approval process, providing any further information that may be required and notifying you of the credit providers decision;
  • Assisting with the finalisation of the loan required

Our “Licensee” obligations to ensure credit is not “unsuitable”

To help us ascertain a credit contract is not unsuitable, we are required by law to:

  • Make reasonable enquiries about your requirements and objectives
  • Make reasonable enquiries about your current financial situation
  • Take reasonable steps to verify the information

If at the time of assessment there is evidence suggesting you are unable to afford the repayments of the credit provided, or the credit provided will cause substantial hardship, or the credit provided will not meet your requirements/objectives, then the credit will be deemed unsuitable.

Due to the importance of proving credit is not unsuitable, we will require a significant amount of information, and accuracy of this information is equally important.

To ensure a credit contract if not unsuitable, we will complete a preliminary assessment of your requirements and financial position. We must keep this preliminary assessment for 7 years. You may request a copy of this preliminary assessment within 7 years of the assistance being provided. We are only required to provide a copy of this assessment if we give you credit assistance.

Consent and Acknowledgement

By signing this document, acknowledging acceptance by submitting your enquiry, emailing your acceptance to us, e-signing this document, or respond by sending through your supporting documentation requested for an application, you:

  • Accept the quote provided for providing credit assistance;
  • Confirm the appointment of the credit license to provide credit assistance and to arrange credit on my/our behalf;
  • Authorise the Credit Licensee to perform the actions outlines in the Privacy Statement section of this document, and acknowledge that I/ We have received a copy of the Credit Guide;

Our Quote for providing you with Credit Assistance

We may charge you up to $2,500 (incl. GST) or up to 10% of NAF as an Origination Fee for our services when providing credit assistance, although this is only payable should the loan proceed. It is a one-off fee, payable at loan settlement. This fee may be paid directly to you, or part of the loan disbursements. If via loan disbursement, this will increase your loan by the fee amount.

Our “Consumer” Credit Providers

We source credit products from a range of banks, lenders and other credit providers. The table below shows the 6 lenders to whom we introduce the most business. It shows the lenders, their estimated establishment fees and other fees that may be payable. Some second tier lenders may charge a risk fee which can range between 1% – 10% of the car price.

Internal Dispute Resolution

Overview – Privacy

Easy drive Pty Ltd, ACN 111 111 111, (‘we’, ‘us’, ‘our’) collects information about you for the purpose you agree to in this Privacy Disclosure Statement and Consent. When you sign below, you agree we can, consistently with Australia’s privacy and credit reporting laws, collect, use and exchange credit and personal information about you for those purposes.

We are collecting credit and personal information (information) about you, as applicable:

To source for you, or a company of which you are a director:

  • Consumer credit for personal, household, domestic or residential investment purposes;
  • Commercial credit for business purposes; or
  • Other services stated in this Privacy Disclosure Statement and Consent (Consent); or
  • To support a guarantor application you will provide.

As your broker, we require the information we collect from your to assess your credit, or guarantor, application or the credit application of a company of which you are a director, source a suitable credit provider and any required insurances and to manage the application process, where required. If you do not provide the information sought we may be unable to process your application, or the company’s application, or we may be limited in the other services we can offer you or the company.

Your information – Collection and Credit Reporting Body (‘CRB’) Disclosures

When we collect information from you in the credit application process, we use that information in a number of ways to assess your credit application and to source a suitable credit provider or lessor/or insurance provider.

  • We may: Disclose your identification information to a CRB if you wish us to obtain a report on your behalf.
  • Use any information the CRB provides in that report to assist us to preliminary assess your consumer credit or guarantor application.
  • Disclose your personal information to an insurer or insurers to source any insurances you wish to obtain.
  • Disclose your credit information top a credit provider or credit providers to apply for finance on your behalf.

The information we obtain from you is used, subject to compliance with Australia’s privacy and credit reporting laws, only for the purposes listed in this Consent and is not disclosed to any other person except with your permission or as permitted, or required, by law.

Credit Providers

As part of providing our services to you, we may undertake tasks for a credit provider which is reasonably necessary to manage the application process. When doing so, we are acting as agent for the credit provider, with the same privacy law requirements applying to both of us.

We may submit your application to one or more credit providers. Those credit providers and their website addresses are set out in the Schedule at the end of this document.

A credit provider, to whom we submit an application, may disclose information about you to, and collect information about you from, from one or more CRBs.

The website of each credit provider contains details of each CRB with which it deals and other detail about information held about you and describes your key rights. This detail may be described on the credit providers’ websites as ‘notifiable matters’, ‘privacy policy’, ‘credit reporting policy’ or privacy disclosure statement and consent’, and includes –

  • That the CRB may include information the credit provider discloses about you to other credit providers to assess your credit worthiness.
  • That, if you become overdue in making consumer credit payments you commit a serious credit infringement, the credit provider may disclose that information to a CRB
  • How you can obtain the credit providers and/or CRB’s policies about managing your credit information
  • Your right to access and/or correct information held about you and to complain about conduct that may breach the privacy and credit reporting laws
  • Your right to request a CRB not to undertake pre-screening for purposes of direct marketing by a credit provider
  • Your right to request a CRB not to release information about you if you believe you are a victim of fraud

This detail will also be included by the credit provider who approves your application in the privacy disclosure statement and consent document it will provide to you.

Each credit provider website includes information on how to contact the credit provider and how to obtain a copy of its privacy documents in a form that suits you (e.g. hardcopy or email).

Your Rights

You have the right to ask:

  • Us to provide you with all the information we hold about you.
  • Us to correct the information we hold if it is incorrect.
  • Us for copies of our privacy policy and this document, in a form that suits you (e.g. hardcopy or email).
  • The CRB not to use our information for direct marketing assessment purposes, including pre-screening.
  • The CRB to provide you with a copy of the information it hold about you.

Electronic Communications Consent (ECC)

I understand and acknowledge that if I give this consent to electronic communications:

  • paper based documents may no longer be given;
  • electronic communications must be regularly checked for documents; and
  • consent to the giving of documents by electronic communication may be withdrawn at any time.

I authorise Company to provide any or all information to me through electronic communication in accordance with the Electronic Transactions Act 1999 and the National Consumer Credit Protection Act 2009, including but not limited to:

  • notices and disclosure documents about my credit application such as a Credit Guide or a copy of my assessment;
  • financial services disclosures such as a Financial Services Guide;
  • credit contract documents or variations to a credit contract;
  • any other notices or documents required by any law; and
  • notices or documents from Company.

I authorise Company to act on instructions I send to them electronically, including but not limited to:

  • email to the email address provided by Company on its websites; or
  • any other method of electronic communication permitted by law.

Providing personal information about other persons

I undertake that if I give Company personal information about another person e.g. my referee, I will show them a copy of this document so they may understand the manner in which their personal information may be used or disclosed by Company in connection with my dealings with Company.

Disclosure and Consent

By Signing below, you agree we may:

Use your personal and credit information:

  • To assess your consumer or commercial credit and/or guarantee application and/or to assess a credit application by a company of which your are a director.
  • To source any finance you require.
  • To source any insurance you require.

As the law authorises or requires:

  • Disclose to, and obtain from, any prospective credit provider or insurer, information about you that is reasonably necessary to obtain the finance and insurances required;
  • Obtain from, and disclose to, any third party information about you, the applicant(s) or guarantors(s) that is reasonably necessary to assist you obtain the finance and insurances required;
  • Provide your information, including your credit report(s), to one or more of the credit providers specified in the Schedule of Credit Providers below so they can assess your application, or the application of a company of which you are a director, or your suitability as a guarantor;
  • Provide credit information about you to a guarantor, or prospective guarantor;
  • Provide you, or the company of which your are a director with offers or information of other goods or services we, or any of our associated entities, may be able to provide to you or the company, unless you tell us not to;
  • Disclose your personal and credit information to the extent permitted by law to other organisations that provide us with services, such as contractors, agents, printers, mail houses, lawyers, document custodians, securitises and computer systems consultants or providers, so they can perform those services for us; and
  • Disclose your personal information to any other organisation that may wish to acquire, or has acquired, an interest in our business or any rights under your contract with us, or the contract with us of a company of which you are a director.

You also agree and consent to, as appropriate:

  • A CRB disclosing consumer credit information to one or more Credit Providers below for the purpose of assessing your application for consumer or commercial credit or your guarantor application, and/or assessing a credit application by a company of which you are a director.
  • When you are a prospective guarantor, a credit provider using that information to assess your suitability as a guarantor.
  • A credit provider disclosing your credit information (including information obtained by it from a CRB) to a guarantor, or a prospective guarantor.
  • A credit provider disclosing to another credit provider, for a particular purpose, information it holds about you.

Where the applicant, or guarantor, is a company of which you are a director, you consent to the use of your information, in addition to the company’s information, in each of the ways listed above.

Authorisation

By signing below, you also authorise us to make a request on your behalf to obtain credit reporting information about your consumer and commercial credit worthiness from a CRB. That information will assist us in providing our services to you. This authorisation ceases when we undertake a task on behalf of a credit provider.

Easy Drive Pty Ltd, ACN 111 111 111, (‘we’, ‘us’, ‘our’) collects information about you for the purpose you agree to in this Privacy Disclosure Statement and Consent. We are collecting credit and personal information (information) about you, as applicable:

To source for you, or a company of which you are a director:

  • Consumer credit for personal, household, domestic or residential investment purposes;
  • Commercial credit for business purposes; or
  • Other services stated in this Privacy Disclosure Statement and Consent (Consent); or
  • To support a guarantor application you will provide.

As your broker, we require the information we collect from your to assess your credit, or guarantor, application or the credit application of a company of which you are a director, source a suitable credit provider and any required insurances and to manage the application process, where required. If you do not provide the information sought we may be unable to process your application, or the company’s application, or we may be limited in the other services we can offer you or the company.

Your information – Collection and Credit Reporting Body (‘CRB’) Disclosures

When we collect information from you in the credit application process, we use that information in a number of ways to assess your credit application and to source a suitable credit provider or lessor/or insurance provider.

  • We may: Disclose your identification information to a CRB if you wish us to obtain a report on your behalf.
  • Use any information the CRB provides in that report to assist us to preliminary assess your consumer credit or guarantor application.
  • Disclose your personal information to an insurer or insurers to source any insurances you wish to obtain.
  • Disclose your credit information top a credit provider or credit providers to apply for finance on your behalf.

The information we obtain from you is used, subject to compliance with Australia’s privacy and credit reporting laws, only for the purposes listed in this Consent and is not disclosed to any other person except with your permission or as permitted, or required, by law.

Credit Providers

As part of providing our services to you, we may undertake tasks for a credit provider which is reasonably necessary to manage the application process. When doing so, we are acting as agent for the credit provider, with the same privacy law requirements applying to both of us.

We may submit your application to one or more credit providers. Those credit providers and their website addresses are set out in the Schedule at the end of this document.

A credit provider, to whom we submit an application, may disclose information about you to, and collect information about you from, from one or more CRBs.

The website of each credit provider contains details of each CRB with which it deals and other detail about information held about you and describes your key rights. This detail may be described on the credit providers’ websites as ‘notifiable matters’, ‘privacy policy’, ‘credit reporting policy’ or privacy disclosure statement and consent’, and includes –

  • That the CRB may include information the credit provider discloses about you to other credit providers to assess your credit worthiness.
  • That, if you become overdue in making consumer credit payments you commit a serious credit infringement, the credit provider may disclose that information to a CRB
  • How you can obtain the credit providers and/or CRB’s policies about managing your credit information
  • Your right to access and/or correct information held about you and to complain about conduct that may breach the privacy and credit reporting laws
  • Your right to request a CRB not to undertake pre-screening for purposes of direct marketing by a credit provider
  • Your right to request a CRB not to release information about you if you believe you are a victim of fraud

This detail will also be included by the credit provider who approves your application in the privacy disclosure statement and consent document it will provide to you.

Each credit provider website includes information on how to contact the credit provider and how to obtain a copy of its privacy documents in a form that suits you (e.g. hardcopy or email).

Your Rights

You have the right to ask:

  • Us to provide you with all the information we hold about you.
  • Us to correct the information we hold if it is incorrect.
  • Us for copies of our privacy policy and this document, in a form that suits you (e.g. hardcopy or email).
  • The CRB not to use our information for direct marketing assessment purposes, including pre-screening.
  • The CRB to provide you with a copy of the information it hold about you.

Electronic Communications Consent (ECC)

I understand and acknowledge that if I give this consent to electronic communications:

  • paper based documents may no longer be given;
  • electronic communications must be regularly checked for documents; and

I authorise easy drive to provide any or all information to me through electronic communication in accordance with the Electronic Transactions Act 1999 and the National Consumer Credit Protection Act 2009, including but not limited to:

  • notices and disclosure documents about my credit application such as a Credit Guide or a copy of my assessment;
  • financial services disclosures such as a Financial Services Guide;
  • credit contract documents or variations to a credit contract;
  • any other notices or documents required by any law; and
  • notices or documents from Boost Money.

I authorise easy drivee to act on instructions I send to them electronically, including but not limited to:

  • email to the email address provided by easy drive on its websites; or
  • any other method of electronic communication permitted by law.

Providing personal information about other persons

I undertake that if I give easy drive personal information about another person e.g. my referee, I will show them a copy of this document so they may understand the manner in which their personal information may be used or disclosed by easy drivein connection with my dealings with easy drive.

Disclosure and Consent

By Signing below, you agree we may:

Use your personal and credit information:

  • To assess your consumer or commercial credit and/or guarantee application and/or to assess a credit application by a company of which your are a director.
  • To source any finance you require.
  • To source any insurance you require.

 

As the law authorises or requires:

  • Disclose to, and obtain from, any prospective credit provider or insurer, information about you that is reasonably necessary to obtain the finance and insurances required;
  • Obtain from, and disclose to, any third party information about you, the applicant(s) or guarantors(s) that is reasonably necessary to assist you obtain the finance and insurances required;
  • Provide your information, including your credit report(s), to one or more of the credit providers specified in the Schedule of Credit Providers below so they can assess your application, or the application of a company of which you are a director, or your suitability as a guarantor;
  • Provide credit information about you to a guarantor, or prospective guarantor;
  • Provide you, or the company of which your are a director with offers or information of other goods or services we, or any of our associated entities, may be able to provide to you or the company, unless you tell us not to;
  • Disclose your personal and credit information to the extent permitted by law to other organisations that provide us with services, such as contractors, agents, printers, mail houses, lawyers, document custodians, securitises and computer systems consultants or providers, so they can perform those services for us; and
  • Disclose your personal information to any other organisation that may wish to acquire, or has acquired, an interest in our business or any rights under your contract with us, or the contract with us of a company of which you are a director.

You also agree and consent to, as appropriate:

  • A CRB disclosing consumer credit information to one or more Credit Providers below for the purpose of assessing your application for consumer or commercial credit or your guarantor application, and/or assessing a credit application by a company of which you are a director.
  • When you are a prospective guarantor, a credit provider using that information to assess your suitability as a guarantor.
  • A credit provider disclosing your credit information (including information obtained by it from a CRB) to a guarantor, or a prospective guarantor.
  • A credit provider disclosing to another credit provider, for a particular purpose, information it holds about you.

Where the applicant, or guarantor, is a company of which you are a director, you consent to the use of your information, in addition to the company’s information, in each of the ways listed above.

Internal Dispute Resolution

Within our business we follow specific procedures to try to resolve any complaints that you may have. If you have a complaint, please contact our office via email at jaime@easydrive.com.au. They will try to resolve all concerns quickly and fairly.

External Dispute Resolution

In the unlikely event we cannot resolve your complaint in a satisfactory manner, or you have not received a response from us after 45 days, you can escalate your complaint to the below Ombudsman, a free and independent dispute resolution service provider.
